  1. Welcome to Adult Aspire. Any access to and/or use of this Website is governed by the Terms and Conditions of use as set out below (“Terms and Conditions”) and the Privacy Notice. Access to and/or use of this Website implies your agreement to and acceptance of these Terms and Conditions and the Privacy Notice. If you do not accept these Terms and Conditions and the Privacy Notice, please do not proceed any further and leave this Website immediately.

     

    Adult Aspire allows Members to contact Performers in the United Kingdom for engagement of their companionship services, and is for access by Users and use by Members and Performers.

    1. Definitions
      1. “Website” – Means the Adult Aspire website, available at https://adultaspire.com;
      2. “Advertiser” – Means a User that has registered his or her details to create an  account in order to advertise services on this Website, including: Escorting services, showing their phone number, premium chat number, Snapchat ID, or Skype ID. Advertisers pay a monthly fee for various services all running month-to-month;
      3. “Performer” – Means a User that has registered his or her details to create an account in order to upload Content onto this Website. Performers may provide webcam shows including for groups or privately for tips / cost-per-minute agreed;
      4. “Performer Account” – Means the account created by a User in order to become a Advertiser or Performer, including the Advertiser or Performer’s profile;
      5. “Content” – Means video, image, text or contact data which is uploaded to the Website by a User, Member, or Performer.
      6. “Company Content” – Means all text, scripts, information, documents, graphics, digital files, photographs and galleries of photographs, mobile Content, sounds, music, or audio-visual files, and interactive features Uploaded by Adult Aspire and contained on this Website;
      7. “Prohibited Content” – Means Content which is prohibited by Adult Aspire. Prohibited Content is further defined in Appendix A to these Terms, titled “Prohibited Content”.
      8. “Member” – Means a User that has registered his or her details on this Website in below to create a Members Account in order to gain access to Content uploaded to this site, and to be able to purchase Tokens;
      9. “Member Account” – Means the account created by a User in order to become a Member, including the Member’s profile;
      10. “Membership” – Means the period of time during which the Member Account is active and has not been cancelled by the Member or by Adult Aspire;
      11. “Privacy Notice” – Means the Privacy Notice, which can be found at: https://adultaspire.com/privacy;
      12. “Upload” – Means the uploading of Content by Members or Performers onto this Website;
      13. “User” – Means a User accessing this Website via a computer or mobile device. The User’s access to this Website will be limited to viewing Company Content and/or Content only. In order to Upload Content onto this Website, or to purchase or exchange Tokens, the User will have to register to become a Member or Performer;

     

    1. Acceptance
      1. These Terms and Conditions are the legally binding Terms and Conditions on the User, Member and Performer in order to gain access to and/or use of this Website. The User, Member or Performer accessing or using this Website will be bound by the following:
        1. The Terms and Conditions found at: https://adultaspire.com/terms.
        2. The Privacy Notice found at: https://adultaspire.com/privacy, and which is incorporated into these Terms and Conditions by reference.
      2. The Member or Performer will be required to expressly accept these Terms and Conditions before the registration process is completed.
        1. During the registration process, the Member will be sent an email containing a link which the Member will need to click to verify the registration and accept these Terms and Conditions. Upon clicking the link to verify the registration the Member’s legal agreement/contract with Adult Aspire shall be formed.
        2. During the registration process, the Performer will be informed that by clicking the ‘Sign Up’ button the Performer accepts the linked Privacy Notice and Terms and Conditions. Upon clicking ‘sign up’ to verify the registration the Performer’s legal agreement/contract with Adult Aspire shall be formed.
      3. Adult Aspire reserves the right to amend or revise these Terms and Conditions and the Privacy Notice at any time and at Adult Aspire’s sole discretion. Any changes to any of these said documents will come into effect at the time they are posted on this Website. The last amendment date will be displayed at the end of the Terms and Conditions and the Privacy Notice. Access to and/or use of this Website by the User, Member or Performer after the Terms and Conditions and the Privacy Notice have been updated constitutes their acceptance as updated.
      4. The User must be over the age of 18 and the User affirms that the User is over 18 years of age (or the legal age to accept these Terms and Conditions in the jurisdiction in which the User accesses the Website – which is 21 in some regions of the world). Any User under the age of 18 (or the legal age to accept these Terms and Conditions in the jurisdiction from which the User accesses the Website) are not permitted to access this Website. If it is discovered that a User provided false information in order to become a Member or Performer, that User will be immediately prevented from accessing and/or using this Website. For the avoidance of doubt, Adult Aspire accepts no liability in respect of access to or use of this Website by any User under the legal age to access our services in their jurisdiction.
      5. Only Users, Members or Performers that are permitted to access and/or use this Website under the laws of the jurisdiction in which they access and/or use this Website shall be permitted to accept these Terms and Conditions and to continue accessing and/or using this Website.

     

    1. Accounts – Registration
      1. In order to Upload Content onto this Website, the User will first have to become a Member or Performer and create a Member Account or Performer Account. When registering, the User must provide accurate and complete information.
      2. In order to gain full access to and/or use of this Website the User may:
        1. Register as a Member; or
        2. Register as a Performer.
      3. For the avoidance of doubt, a User may access this Website without registering as a Member or Performer. Where a User has not registered as a Member or Performer, the User will only have access to limited functionality of this Website.
      4. In order to register on this Website as a Member, a User will:
        1. Be able to choose a username and password that the User will need to enter on this Website once registered. Your username and password must remain confidential.
        2. Have to provide the following information during the registration process to open a Member Account:
          1. First name and surname;
          2. Username;
          3. Email address;
          4. Telephone number and/or SMS number.
        3. Provide evidence of the User’s identity and Date of Birth by way of a Government–issued identity document such as a Passport, Driving License or other Government–recognised photographic ID. The copy of the User’s Passport, Driving Licence, or recognised government identity card will be manually reviewed by Adult Aspire staff to validate the User’s identity and age, and approval of the User’s evidence of identity will be at Adult Aspire’s sole and absolute discretion. Adult Aspire accepts no liability in the event that a User submits fraudulent documentation.
          1. The Member’s age verification information will be processed by our chosen third-party age verification provider. More information is available in our Privacy Notice, included in this Terms of Service document by reference.
        4. Upon completion of the registration process the User shall become a Member.
      5. Performer Accounts: In order to register on the Website as a Performer, a User will:
        1. Be able to choose a username and password that the User will need to enter on the Website once registered. Your username and password must remain confidential.
        2. Have to provide the following information (which must be accurate to the best of their knowledge) during the registration process to open a Performer Account:
          1. First name and surname;
          2. Username;
          3. Email address;
          4. Address;
          5. Telephone number and/or SMS number;
          6. Profile details;
          7. Sex and sexual orientation so that we can match you to ideal partners; and
          8. Services provided, service rates, and details relating to those rates.
        3. Provide evidence of the User’s identity and Date of Birth by way of a Government–issued identity document such as a Passport, Driving License or other Government–recognised photographic ID. The copy of the User’s Passport, Driving Licence, or recognised government identity card will be manually reviewed by Adult Aspire staff to validate the User’s identity and age, and approval of the User’s evidence of identity will be at Adult Aspire’s sole and absolute discretion. Adult Aspire accepts no liability in the event that a User submits fraudulent documentation.
          1. The Performer’s age verification information will be processed by our chosen third-party age verification provider. More information is available in our Privacy Notice, included in this Terms of Service document by reference.
        4. Upon completion of the registration process the User shall become a registered Performer.
      6. Members and Performers must not allow anyone else to use or access their Adult Aspire account unless expressly agreed in writing by Adult Aspire.
      7. In the event that the Member or Performer becomes aware of any unauthorised access to the Member Account or Performer Account, the Member or Performer must notify Adult Aspire immediately by sending an email to: << email address >>.
      8. The Member or Performer must contact Adult Aspire if they have forgotten, lost, or suspect they have forgotten or lost the password to their account.
      9. The Member or Performer will be solely accountable to Adult Aspire or any local law enforcement agencies or any competent authority for all activities taking place in connection with the Member Account or Performer Account.
      10. The Member or Performer will not be entitled to use another Member Account or Performer Account without permission.
      11. The Member or Performer shall not share, sell, or license access to their Member or Performer account to any other person or entity.
      12. In the event that the Member or Performer breaches any of these Terms and Conditions or the Privacy Notice, Adult Aspire reserves the right to immediately revoke the Member or Performer account and to prevent further access to the Website by the User.
      13. Adult Aspire will not be liable to the Member or Performer for any losses incurred by the Member or Performer as a result of unauthorised use of the Member Account or Performer Account. The Member or Performer may be liable to Adult Aspire for any losses incurred by Adult Aspire due to such unauthorised use.

     

    1. Accounts – Suspension and Cancellation
      1. Adult Aspire reserves the right to terminate or suspend a Member or Performer’s account at any time and without notice.
      2. Members or Performers may choose to cancel their accounts at any time.
      3. Any valid subscriptions which are active when a Member cancels their account will remain active until they have expired. The customer will retain access to the services they have purchased until the end of this period.
      4. Performers who choose to cancel their accounts with active subscriptions may have funds withheld. The Performer’s account will also remain live until the last subscription has ceased. Members who are subscribed to the Performer’s disabled account will not be able to renew or recur their subscriptions to the Performer’s account after it has been disabled.
      5. Adult Aspire reserves the right to suspend accounts pending investigation if a Member or Performer is suspected to have violated these Terms. Adult Aspire may terminate accounts where a violation of these Terms has been identified.

     

    1. General Use of this Website – Permissions and Restrictions
      1. Adult Aspire grants the User access to and the Member or Performer permission to use this Website provided that:
        1. The User or Member or Performer acts responsibly in accessing or using this Website and treats other Users, Members and Performers with respect;
        2. The User or Member or Performer does not alter or modify, or attempt to alter or modify, any part of this Website, including any related technologies;
        3. The Member or Performer does not use this Website or Upload Content through any unauthorised means or technology;
        4. The User does not access this Website through any unauthorised means or technology;
        5. The Member or Performer does not exploit this Website by Uploading Content for any commercial activity, without the prior written authorisation of Adult Aspire. Commercial activity includes, but is not limited to:
          1. Sale or access to this Website or any associated services where such sale or access occurs via another website;
          2. Sale of advertisements on any website targeted to the Content Uploaded onto this Website, including Company Content or the Content;
          3. Such other activities that Adult Aspire may specify from time to time.
      2. The User, Member or Performer must not impersonate another person’s identity or misrepresent the User’s, Member’s or Performer’s own identity or affiliation including using any third party’s personal details, or another Member’s or Performer’s password, account name, photo, email address or other such information held as part of the Member’s or Performer’s profile.
      3. For the avoidance of doubt, commercial activity does not include:
        1. Uploading original Content to this Website to promote the Member or Performer; or
        2. Any use of the Website that Adult Aspire expressly authorises in writing.
      4. The Member or Performer must not Upload any copyrighted Content owned by a third party.
      5. The Member or Performer must own the intellectual property rights in the Content they upload to the site, or have appropriate written permission from the owner of the Content.
      6. The Member or Performer agrees that they have reviewed the Prohibited Content list found in Appendix A to these Terms, and that none of the Content they Upload to Adult Aspire falls into any Prohibited Content category.
      7. The Member or Performer agrees that they have reviewed the Banned Words List in Appendix B to these Terms, and that none of the Content they Upload to Adult Aspire will be tagged with any of the included words. Adult Aspire reserves the right to restrict the use of the related words, and any other words, on the platform through the use of technical measures.
      8. The User, Member or Performer warrant that:
        1. The User shall access this Website and the Member or Performer shall only use this Website for purposes that are compliant with the laws of the United Kingdom;
        2. The User, Member or Performer is not offended by nudity, sexual imagery or adult sexual activity;
        3. The User, Member or Performer shall not allow any person under the age of 18 to access and/or use this Website.

     

    1. Use of Company Content and Content on the Site
      1. In addition to the Terms and Conditions of this Website, the following restrictions and conditions apply directly to the User and Member or Performer accessing or using Company Content and/or Content or, where applicable, Uploading Content on this Website respectively:
        1. Adult Aspire owns all Company Content on this Website.
        2. The Member or Performer owns all Content arising out of or in connection with Content Uploaded by that Member or Performer.
        3. The User or Member or Performer is prohibited from downloading, copying, distributing, transmitting, reproducing, broadcasting, displaying, selling, licensing, or otherwise exploiting Company Content or Content on this Website whatsoever without, where concerning Company Content, the prior written consent of Adult Aspire or, where concerning Content, the owner of the Content, except where the Website is configured to enable a download, whereupon the User or Member or Performer may download one copy to a single computer for home–usage during the regular course of browsing this Website. Adult Aspire is not responsible for the websites to which Adult Aspire is linked and does not assume any affiliation with any other websites unless otherwise stated.
        4. The Member or Performer will be prohibited from downloading, copying, distributing, transmitting, reproducing, broadcasting, displaying, selling, licensing, or otherwise exploiting Content from this Website, except Content owned by or licensed to such Member or Performer.
        5. The Member and Performer are prohibited from Uploading any Content that is not original and owned or licensed to the Member or Performer for use on this Website.
        6. For the avoidance of doubt, any comments, including any ratings, made by or Content Uploaded to this Website by the Member or Performer are made in the Member’s or Performer’s personal capacity and Adult Aspire shall not be liable in anyway whatsoever for the display, broadcast, sale, dissemination, reproduction or exploitation of any such comments, including any ratings, or Content.

     

    1. Ownership of Intellectual Property Rights
      1. This Website and any and all Intellectual Property Rights arising out of or in connection with Company Content or this Website are owned by Adult Aspire, save in respect of any Intellectual Property Rights belonging to any licensor, advertisers, partners, investors, sponsors of this Website or arising out of or in connection with any Content Uploaded by any Members or Performers.

     

    1. Use of Content Uploaded
      1. The Member or Performer may Upload Content onto this Website in accordance with these Terms and Conditions. Once the Member or Performer Uploads any Content to this Website, the Member or Performer will retain all ownership in the Intellectual Property Rights arising out of and/or in connection with such Content, provided the Member or Performer is the owner of such rights.
      2. The Member or Performer acknowledges, represents and warrants that:
        1. The Member or Performer has obtained all necessary licenses, rights, consents, and permissions which are required under law to enable Adult Aspire and its successors or assigns to display, broadcast, use, reproduce all of the Content Uploaded by the Member or Performer in connection with this Website or disseminate or distribute such Content Uploaded by the Member or Performer in connection with this Website; and
        2. The Member or Performer will be solely responsible for the Content of Content Uploaded to this Website by the Member or Performer and for any consequential losses including any loss of profit or loss of business incurred by Adult Aspire that may arise from Uploading such Content by the Member or Performer. Adult Aspire shall not be liable to the Member or Performer for any disclosure or exploitation of the Content Uploaded to this Website.
      3. The Member or Performer will not Upload or store on this Website any Content which may violate any third party’s or Adult Aspire’s Intellectual Property Rights, which may violate the laws of the United Kingdom. The Member or Performer will not Upload or store on this Website any Content which may violate the laws of the country in which the Member or Performer accesses and/or uses this Website or Uploads Content to this Website. Members or Performers within the United Kingdom that are producers or consumers in respect of Content should be aware of the Obscene Publications Act and the Criminal Justice and Immigration Act, which criminalises the possession of 'extreme' pornography. Content featuring children or animals or that make references to incest or rape will not be accepted and Adult Aspire shall inform local law enforcement agencies of any such Content Uploaded by any Member or Performer.
      4. By Uploading Content onto this Website, the Member or Performer hereby grants to Adult Aspire and its successors’ business or assigns an irrevocable, perpetual, non–exclusive, royalty–free, world–wide, transferable sub–licence and transferable licence to use, reproduce, distribute any and all of the Content Uploaded by the Member or Performer in connection with this Website, including without limitation, for promoting and redistributing part or all of this Website in any media format without any requirement of prior permission from the Member or Performer, or without any attribution to the Member or Performer. The Member or Performer hereby grants to each other Member or Performer of this Website a non–exclusive licence to access the Content through this Website, and to use, reproduce, distribute such Content as permitted through the functionality of this Website and under these Terms and Conditions. The foregoing licence granted by the Member or Performer will terminate once the Member or Performer, or Adult Aspire, removes or deletes Content or any part thereof from this Website.
      5. All Content that are Uploaded by Members or Performers are subject to approval by Adult Aspire from time to time. Content will be moderated by Adult Aspire on a random basis, or in the event that Content is brought to the attention of Adult Aspire by any User, Member or Performer. The Member or Performer expressly agrees that Adult Aspire may remove, disable or restrict access to or the availability of any Content from this Website (including, but not limited to, Content which the Member or Performer has Uploaded) which Adult Aspire believes, in good faith and in Adult Aspire’s discretion, violate Adult Aspire’s Terms and Conditions or the laws of the United Kingdom. Prohibited Content includes but is not limited to Content which:
        1. Is offensive or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
        2. Harasses or advocates harassment of any group or individual;
        3. Exploits any group or individual in a sexual or violent manner;
        4. Contains nudity, underage nudity, violence, or offensive subject matter;
        5. Solicits confidential or personal information from any group or individual;
        6. Publicly reveals information that poses or creates a privacy or security risk to any group or individual;
        7. Constitutes or promotes information that is knowingly false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous, or is otherwise in the contravention of any of the laws of the United Kingdom;
        8. Involves the transmission of unsolicited mail, instant messages or spam;
        9. Furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to, making or buying illegal weapons, theft, child pornography, sexual assault, violating the privacy of any group or individual, or providing or creating malware; or
        10. Involves commercial activities and/or sales without prior written consent from Adult Aspire.
      6. Adult Aspire is under no obligation to any Member or Performer and therefore may, at Adult Aspire’s discretion, refuse to remove any Content from this Website.
      7. For the avoidance of doubt, the presence of the moderators of this Website shall not place any obligation on Adult Aspire or the moderators to identify Content that is prohibited in the United Kingdom or the country in which the Member or Performer uses this Website or Uploads Content, or the country in which the User, Member or Performer accesses this Website.
      8. Adult Aspire reserves the right, but has no obligation to remove any Content except where Adult Aspire is obligated under the law, and Adult Aspire reserves the right to remove any Content, whenever, and for no reason whatsoever. For the avoidance of doubt, Adult Aspire will co-operate fully with any local law enforcement agencies or any competent authority where necessary in respect of any Content Uploaded by any Member or Performer which breach these Terms and Conditions.

     

    1. Contracts Between Performers and Members
      1. Contracts for services provided are strictly between Performers and Members on the site. Adult Aspire merely facilitates the formation of these contracts.
      2. Disputes arising from contracts formed between Performers and Members will be strictly between the two parties involved. Adult Aspire acts solely as an agent to introduce the parties and accepts no liability to refund Members for issues arising from non-performance of contract on the part of Performers.
      3. In cases of disputes or complaints, Adult Aspire agrees to act as an intermediary for the purposes of mediation between Members and Performers. Adult Aspire reserves the right to suspend or disable the accounts of Performers or Members who are found not to be performing in accordance with the terms of the contracts they form with other Performers or Members.

     

    1. Fees – Subscriptions
      1. Member accounts are granted limited access to browse the site after signing-up and verifying their age, but will be unable to view any adult content until subscribed to a model or the VIP scheme.
      2. In order to view Content from other Users or utilise social media interaction on Adult Aspire, Members must add a payment card to their account and then click the ‘Subscribe’ button on the relevant Content creator’s profile, or join the VIP scheme.
      3. Depending on the choices made when you use Adult Aspire, our third-party payment provider may take monthly payments from your payment card, an/or take ad-hoc payments for individual purchases when the purchases are made.
      4. Members can prevent monthly payments from auto-renewing by disabling the “Auto-Renew” feature located on the relevant Performer’s profile or by contacting Adult Aspire. Disabling the “Auto-Renew” feature will not prevent you from viewing the Performer’s Content until the end of the existing billing period, after which no more payments will be taken and you will return to being unable to see the Performer’s feed.
      5. If a Performer that you are subscribed to increases their subscription costs during a billing period, you will be notified and asked whether you want to accept the increased cost. If you accept the increased subscription cost, this cost will be billed at the beginning of the next billing period. If you do not accept the increased cost or do not respond, your subscription will not auto-renew and will be terminated at the end of the subscription period by default.
      6. We receive the revenue and hold commission on behalf of the relevant creator, and not on your behalf as a customer. Once We have received payment from you as a User, you have no further liability to the relevant provider and the Performer shall allow you as a customer to view the Performer’s content or utilise the one-off services on offer.
      7. Adult Aspire will take payment of the revenue from the Member and hold the commission in the company’s capacity as the agent for the Performer.
      8. All payments made to view Performers’ Content or utilise one-off services are final and non-refundable.
      9. Both standard and VIP subscriptions run for one calendar month from the commencement of the subscription to the model or VIP scheme, and will automatically renew at the beginning of the next billing period unless the subscribing User takes action to prevent this.

     

    1. Fees – VIP Scheme
      1. The Adult Aspire VIP scheme is a subscriber-only scheme with a chargeable monthly subscription which offers a number of benefits for subscribers.
      2. The VIP scheme offers the following benefits for Member accounts:
        1. Members are able to Private Message any active model. If the model is not a Member of the VIP scheme, they will receive 80% of the fees from purchases, after Adult Aspire has deducted our commission.
        2. Members may upload unlimited posts on their profile – This will be free Content for any other Users of the site who follow you.
        3. Members may request private live streaming services with any models who are also Members of the VIP scheme.
        4. Members may purchase exclusive locked Content from any models who are VIP Members without needing to subscribe to that model’s Content feed specifically.
        5. Members may choose to receive notifications for live stream events as they begin.
        6. Members may view exclusive content only available to Members of the VIP scheme.
      3. The VIP scheme offers the following benefits for Performer accounts:
        1. Performers may receive 95% of the revenue from all private work and locked content sales from VIP Members purchases.
        2. Performers are able to live stream to their audience to raise additional revenue.
        3. Performers will be displayed clearly as VIP Users on the search filter, allowing Performers to attract revenue from VIP Members who are not subscribers to the Performer’s feed.
        4. Performers will be able to upload VIP-only content in the form of free content to attract VIP Members to the model’s profile.

     

    1. Fees – Members
      1. Fees paid by Members of the site will be set out on the website from time to time. All amounts stated in these Terms and Conditions, or elsewhere on the Adult Aspire site are exclusive of VAT except where otherwise stated.
      2. You must pay to us the fees in respect of Adult Aspire service in advance, in cleared funds, in accordance with the instructions on the Adult Aspire website.
      3. We may vary fees from time to time by posting new fees on Adult Aspire, but this will not affect fees for services that have been previously paid.
      4. In the event of disputes arising from payments which have already been made to Adult Aspire, you must contact us immediately at the contact details available in these Terms and provide full details of your claim.
      5. If you make an unjustified credit card, debit card, or other chargeback then you will be liable to pay us within 7 days following the date of our written request:
        1. An amount equal to the amount of the chargeback;
        2. Any and all third-party expenses incurred by us in relation to the chargeback (including charges made by our or your bank or payment processor or card issuer);
        3. An administration fee equal to GBP 25.00, including VAT; and
        4. Any and all reasonable costs, losses and expenses incurred in recovering the amounts referred to in this section (including, without limitation, legal fees and debt collection fees).
      6. If, at any time, you owe Adult Aspire any amount relating to these Terms and Conditions, we reserve the right to suspend or withdraw the provision of any services to you.
      7. Adult Aspire may at any time choose to set-off any amount owed to us against any amount owed to you, by sending written notice of the set-off.

     

    1. Fees – Performers
      1. For Performers who are not Members of the VIP scheme, Adult Aspire will deduct commission costs equal to 20% of the total point-of-sale price paid for any purchases of material or Content, tips, or subscription costs. The remainder of this amount will be paid to the Performer immediately.
      2. For Performers who are Members of the VIP scheme, Adult Aspire will deduct commission costs equal to 8% of the total point-of-sale price paid for any purchases of material or Content, tips, or subscription costs. The remainder of this amount will be paid to the Performer immediately.
      3. Performers are able to choose the prices charged for their own Content in terms of subscription costs, locked Content charges and live stream service fees.

     

    1. Live Streaming Functionality
      1. Live streaming functionality is available to registered VIP Members and subscribers only.
      2. Unless otherwise restricted or disabled, Performers will be able to contact VIP Members with notifications regarding times and dates of upcoming live stream performances.
      3. Performances can be either via a private show or chat room service.
      4. Customers are able to contact VIP Performers through private messaging to request specific services.
      5. Fees, show times and live stream duration for performances will be at the discretion of the Performer.
      6. Active chat rooms will be provided for multiple customers to view the performance with a set fee agreed and paid prior to the start of the show.
      7. Performers must state the duration for the live performance prior to the show start and consent to provide as advertised an acceptable adult themed show for at least the time period stated.
      8. Customers will have the ability to chat with the Performers and pay tips during the live performance.
      9. Payments for the performances will be made by Members joining the live stream service 5 minutes prior to the beginning of the scheduled live stream.
      10. All contracts for the paid performance are between the customer and Performer for the live stream and Adult Aspire should be notified of any disputes arising from agreements formed as a result of the live stream feature.
      11. Acceptable performances will consist of what’s explicitly advertised by the Performer prior to the beginning of the show.
      12. No Performer shall invite another person to perform with them unless that Performer is also a verified VIP Member of Adult Aspire.

     

    1. Referral Program
      1. Adult Aspire offers a referral program which aims to incentivise Users of the Website to introduce new modelling talent to the Adult Aspire platform. This Clause sets out the situations in which Adult Aspire will pay an Incentive Payment to Performers who introduce new Performers to the platform.
      2. Customers with a valid Member or Performer account can participate in the Referral Program.
      3. Each account is provided with a unique referral URL or code which the User can provide to new Users in order to earn incentive payments.
      4. The referred Performer must use the referring User’s unique URL and register with Adult Aspire using the same browser session which they used to click the referral link.
      5. The referred Performer has to be a Performer who has not previously held a Performer account with Adult Aspire. If the referred Performer has been, or is currently, a Performer with Adult Aspire, then Adult Aspire reserves the right not to pay the Incentive Payment to the referring User.
      6. Adult Aspire will not be able to pay the Incentive Payment if the referred Performer does not join Adult Aspire by using the correct referral link or code.
      7. If the referred Performer creates multiple Performer accounts with Adult Aspire, then Adult Aspire shall only be obliged to pay Incentive Payments with regard to commission earned from the first account which the Performer creates. The referred Performer will only be a new Performer with respect to the first account.
      8. Users must not attempt to impersonate Adult Aspire when referring new Users. Adult Aspire reserves the right to refuse the payment of Incentive Payments if a User is discovered to be impersonating Adult Aspire when distributing their referral links or codes.

      10. In the event that Incentive Payments arising from this Referral Program are paid incorrectly, in error, or as a result of fraudulent referrals, Adult Aspire reserves the right to recover erroneously paid money from the receiving Performer.
      11. In order to maintain the integrity of the Referral Program, Adult Aspire reserves the right to verify the credentials and identity of referred Performers and referring Users claiming to have introduced the referred Performers.
      12. Incentive Payments will be processed and paid on the first calendar business day of each month, in accordance with our Payment Provider’s terms.
      13. Incentive Payments are formed from money deducted from the balance that Adult Aspire would otherwise retain from the transaction, and not from the money earned by the referred User.

     

    1. Social Networking Features
      1. Registered Users will have access to social networking features of Adult Aspire, granting them the ability to message Users they are subscribed to. This feature can be disengaged for privacy if desired by the User.
      2. Registered Users will have the facility to message specific Members through the Adult Aspire platform, and to post and publish text and media on the platform.
      3. Adult Aspire accepts no responsibility or liability for any content published by Users of the platform.
      4. Members and Performers may not, without express permission, copy or distribute Content owned by the Performer or content publisher, and violation of this rule will lead to the User’s account being suspended by Adult Aspire.

     

    1. Instant Payments
      1. Adult Aspire operates an instant payment process to Performers. Payments will be made to Performers immediately when purchases of the Performer’s Content are made and have been confirmed. The timescale for fees becoming available in your bank account is dependant on the timescales allowed by your bank account and payment method, and may also be subject to your country or region of residence.
      2. Adult Aspire will make payments instantly on a best-effort automated basis, but accepts no liability for any delays which caused by banking or payment systems outside of our control.
      3. Adult Aspire reserves the right to alter or amend this process of instant payment as a result of abuse or fraud, and may withhold a small retainer to ensure cases of monetary disputes can be resolved.

     

    1. Taxation and Other Charges
      1. It is the responsibility of Performers and Members to plan, manage and pay all taxes or VAT on any relevant income in accordance with the rules of their country or territory of residence. Adult Aspire accepts no liability for unpaid taxes or wrongly-filed taxes which are the responsibility of Performers.

     

    1. Xero Integration
      1. Adult Aspire offers complementary integration with the Xero accountancy software for Users who wish to integrate their Adult Aspire financial information with the platform.
      2. The Xero platform is a third-party platform not provided by Adult Aspire and they have separate Terms and Conditions which must be read individually.
      3. Adult Aspire accepts no liability for losses arising from the use of the Xero integration or Xero platform.

     

    1. Termination Right
      1. The licences granted by the Member or Performer in Clause 8 above, will terminate when the Member or Performer removes or deletes Content from this Website. In the event that the Member or Performer elects to terminate the Member’s or Performer’s legal agreement/contract with Adult Aspire, the above licences granted by the Member or Performer in the Content that is not removed or deleted by the Member or Performer prior to the closing of the Member Account or Performer Account are perpetual and irrevocable, but are otherwise without prejudice to the Member’s or Performer’s ownerships rights.

     

    1. Disclaimer of Content
      1. Adult Aspire does not in any way whatsoever endorse any Content Uploaded to this Website by the Member or Performer and expressly excludes any and all liability in connection with the Uploading of such Content by the Member or Performer.

     

    1. Limitation of liability

Adult Aspire reserves the right to suspend or instantly remove violators for engaging in any online harassment.         3. Adult Aspire elects to terminate access to and/or use of this Website to Members or Performers situated in the country in which the Member or Performer is resident or from which the Member or Performer may wish to access and/or use this Website;
        4. The Member or Performer Uploads any unlawful or offensive Content or any Content that breaches any provision of these Terms and Conditions;
        5. The Member or Performer is found to be manipulating this Website by carrying out any activities including, but not limited to, hacking, using Trojan computer programs, attempting to launch automated systems, spiders or offline readers;
        6. The Member or Performer attempts to harvest personal information located on this Website;
        7. The Member or Performer uses the Website for non–agreed commercial purposes;
